Please read the following Terms and Conditions ("Terms") before using your Credit Card. Under these Terms, Metrobank refers to "us," "we," "our," or "Bank," while "you," "your," and "Customer" refers to you as the Credit Card Member (“Card Member”) and your co-obligor or Supplementary Card Member(s), if any. You and your co-obligor are bound to faithfully comply with the Terms governing the issuance and use of your Credit Card or any renewal thereof.
Your continued use of your Metrobank Credit Card shall mean your acceptance of these Terms, as may be subject to change upon notice. Capitalized terms used in this Terms and Conditions will have the same meaning specified in the General Banking Terms and Conditions (“GBTC”). These Terms also supplement the GBTC. In the event of conflict between the GBTC and this Terms and Conditions, in so far as the product and commercial features are concerned, the latter will prevail.
We will notify you of any amendments to our terms and conditions through the appropriate communication channels at least (60) days before implementing the changes or as prescribed by the Bangko Sentral ng Pilipinas (“BSP”), applicable law, rules, or regulations. 2. AUTHORITY TO ISSUE CREDIT CARD. Subject to existing laws and regulations and in relation to Section 34 (Ownership of the Credit Card), the Card Member, Supplementary Card Member(s) and co-obligor, if any, authorize Metrobank to issue and/or replace, at any time and at its discretion, any and/or all Credit Card product/s in case the Card Member is qualified for membership and after due credit evaluation has been done, even without the written conformity of, or notice to the co-obligor or Supplementary Card Member(s). The continued use of the Credit Card, Credit Card activation, signing on the application form, acknowledgement receipt, or at the back of any Credit Card product/s shall constitute conclusive proof of consent of the Card member, Supplementary Card Member(s) and/or co-obligor to be bound by the foregoing Terms and Conditions. The Card Member, Supplementary Card Member(s) and the co-obligor agree to hold Metrobank free and harmless from any and all liabilities in the exercise of said discretion.
3. COOLING-OFF. The Card Member and/or Supplementary Card Member(s) may be entitled to a cooling off period of two (2) banking days after availing the Card. During this cooling-off period, the Card Member and/or Supplementary Card Member(s) has the option to request for and provide notice of cancellation of the Card availed to the Bank. However, the Bank reserves the right to collect processing and administrative fees including applicable taxes and Total Outstanding Balance, if any.
4. SUPPLEMENTARY CARD(S). The Card Member may apply in writing for issuance of Supplementary Credit Card(s). Approval and issuance of Supplementary Credit Card(s) shall be at the sole discretion of Metrobank even without the written conformity of, or notice to, the co-obligor. The use of the Supplementary Credit Card(s) shall be similarly governed by these Terms and Conditions. The Card Member shall have the option to assign monthly spending limits to each Supplementary Card Member.
Unless otherwise expressly stated in this Terms and Conditions, or unless it contradicts the true intention of the provisions herein, the term “Card Member” used in this document shall include the Supplementary Card Member(s) of the Card Member.
5. CORPORATE ACCOUNTS. In case of corporate accounts, the company shall be considered as the Card Member, but the Credit Card(s) shall be issued in the name of the company’s authorized representative(s) subject to the evaluation and approval of Metrobank.
6. ANNUAL MEMBERSHIP FEE. The Card Member shall pay an annual membership fee in such amounts as may be fixed and announced by Metrobank. Renewal and/or reinstatement of the Credit Card shall be at Metrobank’s exclusive option. All paid membership fees are non-refundable even if the Credit Card privileges are suspended or terminated, or if the Credit Card is surrendered by the Card Member before the expiry date.
7. LIABILITY OF CARD MEMBER, CO-OBLIGOR, SUPPLEMENTARY MEMBER(S) AND COMPANIES (Corporate Accounts). The Card Member, Supplementary Card Member(s) and/or co-obligor, if any, shall be jointly and severally liable to pay all purchases, cash advances and all charges, including, but not limited to, the non-refundable fees, charges and taxes required by the government, made and imposed through the use of the Principal and Supplementary Credit Card(s), without necessity of proof of a signed charge slip or other documents. In case of corporate accounts, the company and its authorized representative(s) shall be jointly and severally liable for the payment of the same, without necessity of proof of a signed charge slip or other documents, whether or not the same were incurred for the company. Said obligation shall continue in case the Credit Card is renewed or reinstated by Metrobank, even without the written conformity of, or notice, to the co-obligor, and despite the suspension or termination of the Credit Card.
In the event that the Supplementary Card Member is the Card Member’s spouse and there is separation between the spouses, legal or otherwise, the Card Member shall continue to be responsible for all such amounts incurred through the use of the Supplementary Credit Card(s) unless Metrobank receives a Card Member’s requests in writing to terminate the privileges extended to such Supplementary Card Member and the Total Outstanding Balance incurred shall have been fully paid and satisfied at the time of receipt of said request. In case of death of the Card Member, the Supplementary Card Member shall be jointly and severally liable to settle the Total Outstanding Balance due.
8. SURETY. The Card Member’s spouse who is a Supplementary Card Member, or the company in case of corporate accounts stated in Clause 7 above, shall automatically become a surety who shall be jointly and severally liable with the Card Member herein and in all renewals hereof. In all other cases, the Card Member’s spouse shall be jointly and severally liable for all obligations and charges incurred herein including (but not limited to) all availments, advances, and charges using the Credit Card and the Supplementary Credit Card(s) and any renewal thereof.
Notwithstanding the foregoing and at Metrobank’s request, the Card Member shall furnish surety(ies) acceptable to Metrobank who shall be jointly and severally liable with the Card Member and/or the Supplementary Card Member to pay Metrobank all the obligations and charges herein and in all renewals hereof, incurred through the Credit Card and the Supplementary Credit Card(s). In the event the surety(ies) furnished by the Card Member are discharged, if required, the Card Member must furnish new surety(ies) acceptable to Metrobank within thirty (30) calendar days from discharge. Failure to do so shall constitute prima facie evidence of intent to defraud on the part of Card Member and the Card Member’s privileges shall be automatically terminated. It is agreed that the surety(ies) can be discharged by Metrobank only when Total Amount Due has been fully paid.
9. PROHIBITED USE OF THE CARD. The Card Member and/or Supplementary Card Member shall not use the Credit Card after its expiry date, cancellation, suspension, termination, withdrawal, or permit other persons to use the Credit Card for any reason whatsoever. Continued use of the Credit Card thereafter shall be considered as a fraudulent act of the Card Member and/or Supplementary Card Member(s).
10. CASH ADVANCES. The Card Member and/or Supplementary Card Member (s) may, upon full satisfaction of the credit requirements of Metrobank, avail of cash advances through Metrobank or PSBank branches, or automated teller machines (ATMs). For this purpose, a confidential Personal Identification Number (PIN) shall be provided to the Card Member and/or Supplementary Card Member(s). In case of ATM cash advances, the Card Member and/or Supplementary Card Member(s) shall use the PIN, which may be changed only by requesting for a card replacement or requesting for PIN change through Metrobank Customer Service. At all times, Card Member and/or Supplementary Card Member(s) shall keep the PIN confidential and under no circumstances should Card Member and/or Supplenetary Card Member(s) disclose the PIN to any person or compromise its confidentiality.
The Card Member shall pay Metrobank a cash advance fee in addition to a finance charge calculated from the transaction date. It is understood and agreed that all cash advances made with the use of the Credit Card shall be solely for the account of the Card Member who, hereby, expressly waives the presentation of any supporting document in relation thereto, the records of Metrobank being conclusively presumed to be correct. Metrobank may limit cash advances on the Credit Card to an amount determined at Metrobank’s sole discretion, with notice to the Card Member.
11. INTERNET TRANSACTIONS. The Card Member and/or supplementary member(s) is/are solely responsible for the security of his/her Card at all times, especially in connection with the use of the Card to purchase goods and/or services through online internet sites or portals. The Card Member and/or supplementary member(s) agree that the entry of his/her card information on the internet is sufficient proof that instructions were given for the use of the Card, and that Metrobank is not required to verify the identity or the authority of the person entering the Card information. However, Metrobank may choose not to carry out any transactions over the internet if it has any reason to doubt its authenticity or if in its opinion it is unlawful or otherwise improper to do so or for any other reason.
12. FOREIGN EXCHANGE TRANSACTIONS. Metrobank shall automatically convert all charges, advances, credit adjustments, or amounts arising from transactions denominated in foreign currency to Philippine Peso or to US Dollar for US Dollar Credit Cards.
Transactions denominated in US Dollar, Hong Kong Dollar, Japanese Yen, Euro, Singapore, Dollar, Australian Dollar, British Pound, Canadian Dollar, Chinese Yuan, Swiss Francs, and Danish Kroner will be converted using the prevailing foreign exchange selling rate of Metropolitan Bank & Trust Company on transaction posting date. Transactions denominated in currencies other than the aforementioned will be converted using Mastercard / Visa’s currency conversion rate at the time of posting. All converted transactions shall be charged a Cross Border Service Fee plus Forex Processing Fee for Peso Credit Cards or Forex Processing Fee for USD Dollar Credit Cards, the rates of which may be adjusted from time to time upon notice. The Cross Border Service Fee represents the costs incurred to process the payment for the foreign currency transactions through the Card Network (i.e. Visa, Mastercard), acquiring bank and/or foreign merchant affiliates. The Forex Processing Fee represents the costs needed by Metrobank to internally process the foreign currency transactions. The Cross Border Service Fee shall likewise apply to transactions involving foreign currencies converted to Philippine Peso (PHP) at point of sale, whether executed in the Philippines, abroad, or online.
The said fees will not be automatically reversed in case of transaction refund and Metrobank has the sole discretion on the reversal of the fees.
13. OVERLIMIT. The Card Member and/or supplementary member(s) shall keep track of his/her total obligations so as not to exceed the approved credit limit at any given time. The cash advance and installment transactions form part of the total combined credit limit. The indication of a credit limit on the Credit Card account shall not relieve the Card Member, supplementary member(s), and co-obligor from liability for all purchases, cash advances, fees and charges in excess of said credit limit.
Metrobank reserves the right, with notice to Card Member, to decline any transaction, suspend the Credit Card privileges of the Card Member and his/her supplementary member(s) and/or process the transaction and charge an over limit fee for every occurrence, if the credit limit will be or has been exceeded. For purposes of assessing the over limit fee, the approved combined credit limit for both Principal and the Supplementary Card Member(s), or the total combined credit limit if two (2) or more cards are issued, shall be the basis of the computation.
Metrobank may demand immediate payment of the amount in excess of the credit limit or of all amounts outstanding.
Credit limit will be replenished only after payments have been posted to Card Member’s Credit Card. It is advised that the Card Member check with Metrobank Customer Service availability of credit prior to using his/her Credit Card if payment was not made on the cut-off indicated in this card carrier to avoid transaction issues. For check payments, credit limit will only be replenished after the funds have been cleared.
14. INCREASE/DECREASE IN CREDIT LIMIT. Metrobank may implement any increase or decrease in the credit limit applicable on the Credit Card account based on its policies, whereas Card Member may decline any credit limit increase on the account. The Card Member also has the option to request for a credit limit adjustment upon submission of updated information, subject to the approval of Metrobank.
The credit limit for Cards issued under Mastercard, Visa, and other card brands is further subject to their respective rules or guidelines, as the same may be amended or supplemented from time to time.
15. PAYMENT DUE DATE. Card Member’s Payment Due Date is indicated in the Statement of Account. The Card Member may call the Metrobank Customer Service Hotline at 88-700-700 (Metro Manila) or 1-800-1-888-5775 (Domestic Toll-Free using a PLDT line) if the Card Member still has not received the statement of account a week before the usual Payment Due Date.
16. STATEMENT OF ACCOUNT (SOA). Metrobank shall furnish the Card Member a monthly SOA containing the summary of all Credit Card transactions, fees and charges. The SOA shall be furnished by Metrobank by mail, email or through other modes deemed appropriate by Metrobank. The SOA shall be conclusively presumed to have been received by the Card Member during the applicable month unless the Card Member notifies Metrobank through telephone or in writing of his/her failure to receive a copy of such within the first twenty (20) days of the succeeding month. The SOA shall likewise be conclusively presumed to be correct unless the Card Member notifies Metrobank through telephone or in writing of any error within thirty (30) days from statement date. The Card Member undertakes to send the signed and completed dispute form which may be downloaded from our website at https://www.metrobank.com.ph/downloads and email to [email protected] for disputed transactions. Notwithstanding anything to the contrary, non-receipt or late receipt of the SOA shall not relieve the Card Member of his/her obligations to pay amounts due to the Credit Card on Payment due date. Metrobank shall be notified immediately through the Metrobank Customer Service Hotline at 88-700-700 (Metro Manila) or 1-800-1-888-5775 (Domestic Toll-Free using a PLDT line), and in writing of any billing error in the SOA. The Card Member and the supplementary member(s) recognize and admit the integrity of the SOA if it is in an electronic form pursuant to the provisions of the Electronic Commerce Act and agree to pay the amount thereon on Payment Due Date without need for presentation of printed or signed charge slips.
17. CARD PAYMENT. The Card Member shall be liable to pay the Total Amount Due on or before the Payment Due Date as shown in the monthly SOA given to the Card Member. The Card Member, however, shall have the option to pay the Total Amount Due, the Minimum Amount Due, or any amount in between the Total Amount Due and Minimum Amount Due. In any event, the Card Member must pay at least the Minimum Amount Due, on or before the Payment Due Date. All payments made by the Card Member must be in the billing currency of the issued Credit Card.
The Minimum Amount Due is computed as the sum of the following:
a. *Outstanding balance as of statement date (including monthly installment amortizations, if any) multiplied by 3.5%; plus
b. Any amount in excess of the approved credit limit; plus
c. All past due amounts, if any; or
d. A required minimum amount imposed by Metrobank, whichever is higher.
*Outstanding balance as of statement date is equal to Total Amount Due less overlimit amount less past due amounts.
The Payment Due Date may be changed to an earlier date if the Card Member’s account is considered overdue and/or with balances in excess of the credit limit, or to such other date as may be deemed proper by Metrobank with notice to the Card Member on the same monthly SOA. Should the Payment Due Date fall on a Saturday, Sunday or non-working holiday, the payment due date is automatically moved to the next business day. The Card Member agrees to pay any and all purchases, availments, and cash advances on his/her Credit Card notwithstanding the absence or lack of proof of service of the SOA on the Card Member within thirty (30) calendar days from actual date(s) of purchase, availment or cash advance.
18. MODES OF PAYMENT. All purchases, cash advances, fees and charges shall be paid by the Card Member, supplementary member(s) and/or co-obligor in cash or check directly with Metrobank and PSBank branches, or other Metrobank authorized payment centers, or available channels such as Automated Teller Machines (ATM), phone banking, mobile banking and other applicable internet facilities on or before the Payment Due Date indicated in the SOA without necessity of demand.
a. Subject to Card Member’s enrollment, an Automatic Debit Arrangement (ADA) may also be made in case the Card Member, supplementary member or co-obligor has a deposit/placement account with Metrobank. Should the due date fall on a Monday, we will put on hold the ADA amount two (2) calendar days before your due date:

b. c. Payments made through any authorized payment channels, including check payments, shall be considered as payment on the same date. Credit limit shall, however, be replenished only upon posting of payment, the date of which may vary subject to the cut-off schedules of each of the bank’s accredited payment channels.
19. APPLICATION OF PAYMENT. In case of partial payment of the Credit Card balances, payments in excess of the minimum amount due will first be applied to the fees and charges, and then to the billed balance bearing the highest rate of interest, followed by the billed balance bearing the next higher rate of interest, until the payment is exhausted. As such, payment shall be applied in the following order.

In case Card Member is issued two or more Credit Cards, Card Member authorizes Metrobank, without any obligation on its part, to apply Card Member’s payments to any of Card Member’s Credit Card accounts at Metrobank’s sole option and discretion.
20. INSTALLMENT PROGRAMS. PPrograms such as Merchant Installment, Cash2Go, Balance Conversion and Balance Transfer shall be available to Card Members who are qualified based on Metrobank’s criteria. Metrobank reserves the right to approve or reject any application to avail of any of the following programs, without giving any reason therefor.
a. MERCHANT INSTALLMENT. The Metrobank Merchant Installment Program allows the Card Member to purchase selected goods and services on installment from accredited Metrobank merchants in the Philippines. All installment purchases are subject to Metrobank’s approval and, when applicable, may only be valid if monthly dues are paid in full. Metrobank may require a minimum transaction amount.
b. CASH2GO. The Cash2Go Facility allows a qualified Card Member to avail of cash charged to the Card which, together with applicable interest and other fees, shall be paid for by the Card Member on an installment basis. Metrobank may require a minimum transaction amount. The approved Cash2Go amount must not exceed the Card Members available Credit Limit. The approved Cash2Go Amount availed may be disbursed via credit to the Card Member’s valid current or savings account. This Facility is not applicable to corporate, time deposit, cash deposit and Dollar accounts.

c. BALANCE CONVERSION. Under the Balance Conversion program, a qualified Card Member may apply with Metrobank to convert their current Metrobank Credit Card outstanding balances, inclusive of finance charge and other fees and charges, into installment. Metrobank may require a minimum transaction amount. The Balance Conversion amount must not exceed the Card Members outstanding balance.The Balance Conversion request shall be subject to verification and approval of Metrobank.

d. BALANCE TRANSFER. Under the Balance Transfer Facility, a qualified Card Member may apply with Metrobank to transfer to his/her Credit Card his/her other outstanding Credit Card balances with other banks or Credit Card companies. The other Credit Card must be issued in the name of the Card Member. The Balance Transfer request shall be subject to verification and approval of Metrobank. The approved Balance Transfer Amount must meet the following requisites:
i. Must be at least the minimum amount required by Metrobank;
ii. Must not exceed the principal Card Member’s Available Credit Limit. If the Balance Transfer applicant is the supplementary of the Card Member, the Balance Transfer amount must also not exceed his/her available Monthly Spending Limit; and
Only the amount of transactions that form part of a Card Member’s outstanding balance on the non-Metrobank Credit Card at the time of application may be subject to Balance Transfer. In the case of installment transactions, only the monthly installment amount posted to the card at the time of application will be covered by the Balance Transfer transaction. Metrobank shall handle payment delivery to the issuer of the Card Member’s non-Metrobank Credit Card(s).

e. APPROVAL. All Special Installment Facility applications are subject to verification and approval by Metrobank. Metrobank has the absolute and exclusive right to approve or reject installment application.
Once the application has been approved, the principal amount and processing fees shall be earmarked against the cardholder’s available credit limit at the time of application. The applicable interest will only be deducted from the cardholder’s available credit limit upon billing for the monthly amortization.
All approved Special Installment Facility applications are deemed irrevocable and may not be cancelled.
In case of full or partial disapproval, Metrobank shall not be liable for any delinquency, interest charges, penalty charges, and other costs incurred by the cardholder as a consequence of Metrobank’s disapproval of the application.
f. MONTHLY INSTALLMENT AMORTIZATION. A monthly add-on rate based on prevailing rates will be levied on the amount applied for installment. The interest is computed by multiplying the principal amount with the monthly interest rate multiplied by the chosen payment term.
The Monthly Effective Interest Rate (EIR) refers to the rate that exactly discounts estimated future cash flows through the life of the installment to the net amount of the installment proceeds.
The computation of the Monthly Installment Amortization shall be based on the diminishing balance method. The interest per installment period shall be calculated based on the remaining principal balance of the loan at the beginning of each installment period, and the principal and interest components of the computed installment amortization for the duration of the term will vary per billing month.
The Monthly Installment Amortization shall be posted on the cardholder’s monthly Statement of Account (SOA) together with the cardholder’s other transactions, if any, and will form part of the cardholder’s Total Amount Due. Succeeding monthly amortizations shall be billed to the cardholder until Total Amount Payable is billed in full.
21. FINANCE CHARGES. If the Card Member opts to pay the Minimum Amount Due or any amount less than the Total Amount Due, the Card Member agrees to pay the finance charge and other charges, as provided by Metrobank, plus any applicable taxes and charges required by the government on such charges. The finance charge, at Metrobank’s prevailing rate, will be computed based on the unpaid balance as of the given cut-off date and shall continue to be imposed until the outstanding balance and applicable interest are fully paid.
Card member’s previous outstanding balance as reflected in the current Statement of Account (SOA) computed from a day after the cut off if the previous SOA to a day before the payment transaction date, plus Card Member’s previous outstanding balance less payment/s made and any credit adjustments computed from the payment transaction date to the beginning of the next statement cut-off.
Interests on Cash Advances are computed from the transaction date.
22. PAYMENT FOR INSTALLMENT PROGRAMS. The corresponding approved principal amount and processing fee will be deducted against the Card Member’s available credit limit at the time of approval. The applicable interest will only be deducted from the Card Member’s available credit limit upon billing of the monthly amortization. A monthly interest rate based on prevailing rates will be levied on the amount applied for installment. The interest is computed by multiplying the principal amount with the monthly interest rate multiplied by the chosen payment term. The Monthly Amortization is computed by dividing the Total Amount Payable (Principal plus the Total Interest Rate) with the chosen payment term. Successive installment amortizations shall be billed to the Card Member in the succeeding Statement of Accounts until the Total Amount Payable is billed in full.
Portion of the monthly installment amortization shall form part of the Minimum Amount Due in the SOA. If the Card member opts to pay only the Minimum Amount Due or any amount below the Total Amount Due, only a portion of the monthly installment amortization shall be considered paid based on Application of Payment. The unpaid portion of the monthly installment amortization shall be subject to the regular finance charges.
If the Card Member chooses to pre-terminate the installment contract with Metrobank, a cancellation fee shall be billed to the Card Member. Any remaining balance (i.e. remaining principal amount based on Diminishing Balance computation and/or penalties, interest and other charges) shall be billed in the next statement cycle together with the applicable interest charge. Unbilled interest for accelerated amortizations are forgone or will no longer be collected.
23. OVERPAYMENTS. Overpayments shall be applied to succeeding Credit Card usages and charges. In case of overpayments on closed accounts, a monthly account maintenance fee, or amount equivalent to the credit balance, whichever is lower will be charged to accounts with credit balance that are closed or with no activity for the past 12 months. Overpayments shall not earn interest.
Card Member further authorizes Metrobank, without any obligation on its part, with reasonable notice, to likewise apply to any of Card Member’s outstanding obligations with Metrobank any payments made by Card Member or amounts due the Card Member resulting from overpayments.
In the event that Card Member has no outstanding obligations with Metrobank, or, after applying any overpayments to the Card Member’s outstanding balances, there remains an excess, the Card Member may file an application for refund of overpayments by submitting a written request and providing all necessary documents, which may be requested by Metrobank through the Metrobank Customer Service Hotline at 88-700-700 (Metro Manila) or 1-800-1-888-5775 (Domestic Toll-Free using a PLDT line). In cases where the Card Member dies, becomes legally incapacitated, or is declared absent or presumptively dead, only the Card Member’s heirs may file for an application for refund of overpayments.
24. LATE PAYMENT FEE. If the Card Member fails to pay at least the Minimum Amount Due on or before the Payment Due Date, a late payment fee will be imposed on the Credit Card account and will be reflected in the next cycle’s SOA.
25. DISHONORED CHECK PAYMENTS. In the event of dishonor of check payments, a returned check fee plus applicable actual bank charges shall be imposed. The imposition of said charges shall be without prejudice to the right of Metrobank to:
a. prosecute the check drawer/issuer for violation of existing criminal and special penal Laws;
b. consider all charges due and demandable; and
c. suspend or terminate the principal or Supplementary Credit Cards.
Further, Metrobank reserves the right to re-deposit the dishonored checks, such as but not limited to, checks Drawn Against Uncleared Deposit (DAUD), Drawn Against Insufficient Funds (DAIF), and/or Post Dated Checks (PDC), within a reasonable period of time, and without need of prior consent of the Card Member.
26. OTHER FEES. The Card Member agrees to pay such other fees that may be imposed by Metrobank at its option. The Card Member agrees that the following amount of listed fees below may be revised from time to time as Metrobank may deem necessary.
a. REFUND FEE. For Peso Card, A fee of 1% of the refund amount or Php100 whichever is higher and for Dollar Card, 1% of the refund amount or USD2 whichever is higher, will be charged for each refund request by the Card Member of any overpayment.
b. GAMING TRANSACTION SERVICE FEE. A 5% service fee will be levied on gaming transactions. Gaming Transactions include those that involve the placement of wager, purchase of lottery tickets, in-flight commerce gaming, and the purchase of chips or other values in conjunction with gaming activities provided by establishments such as casinos, race tracks, airlines, and the like.
c. SALES INVOICE RETRIEVAL FEE. A fee of Php300/USD6 will be charged for each sales invoice requested for retrieval by a Card Member to verify a transaction.

27. DEFAULT. The Credit Card account shall be deemed in default when Card Member is unable to pay at least the Minimum Amount Due on or before payment due date. In which case, the Total Amount Due shall become due and demandable without need of notice or demand. Metrobank reserves the right to accelerate the Card Member’s deferred charges as a consequence of default.
In case the Card Member has other Credit Card and/or Loan accounts with Metrobank, a default in one shall be considered as a default in the other account/s. Metrobank reserves the right to suspend or terminate the use of all Credit Card privileges of the Card Member for all his/her Credit Card accounts, in view of the default in their other Credit Card and/or Loan accounts with Metrobank.
The Card Member, Supplementary Card Member(s) and/or co-obligor hereby give Metrobank a general lien upon, and/or right of set-off, and/or right to hold and/or apply to the obligation herein all rights, titles and interests in and to the balance of every deposit account, now or anytime hereafter existing, with Metrobank or PSBank or First Metro Investment Corporation or Orix Metro Leasing and Finance Corporation, its agents or any of its branches, subsidiaries or affiliates (collectively, the Metrobank Group), and in and to all money, negotiable instruments, commercial papers, notes, bonds, stocks, dividends, interests, credits, choses in action claims, demands, or any interests in any thereof, and in any other property, rights and interests or any evidence thereof, which have been or at any time shall be delivered to, or otherwise come into the possession, control or custody of the Metrobank Group, for any purpose, whether or not accepted for the purpose/s for which they are delivered or intended. For this purpose, the Card Member, Supplementary Card Member(s) and/or co-obligor, hereby appoint Metrobank as their irrevocable Attorney-in-Fact with full power of substitution/delegation to sign and endorse any and all documents and perform any and all acts and things required or necessary in the premise.
Above remedies shall also be available to Metrobank in the following events where Card Member shall also be considered in default in any of its loan obligations with Metrobank:
a. Any creditor tries, by legal process, to seize the money or any property of the Card Member held by the Metrobank Group;
b. The Card Member applies for voluntary or involuntary relief under the Insolvency Law or other bankruptcy laws;
c. Metrobank believes, on reasonable grounds, that it was induced by fraudulent misrepresentation to grant the credit facility in favor of the Card Member;
d. The Card Member fails to observe any of the terms and conditions of any agreement relating to the Credit Card, without limitation, the Cash Advance, Cash2Go, Installments, Balance Conversion, Balance Transfer and other future promotions;
e. The Card Member fails to observe any of the terms and conditions of any contract or evidence of indebtedness and/or other related documents which the Card Member executed, or were otherwise issued by Metrobank, the Metrobank Group, or another financial institution or other lenders, relevant card association or network rules, in connection with any credit and loan facilities granted in favor of the Card Member; or
f. The Card Member is charged with, convicted of, or under investigation by competent government authority for violation of Republic Act No. 8484 (Access Devices Regulation Act of 1998) and other laws or regulations relating to Credit Cards, or Metrobank has prima facie evidence to charge the Card Member with violation of any of the provisions of such laws or regulations; or
g. Card Member dies, becomes legally incapacitated, insolvent, judicially declared absent or presumptively dead; or
h. Card Member engages in any fraudulent, illegal or unlawful activity, or if Metrobank reasonably suspects that the Card Member has engaged in fraud, illegal or an unlawful activity in connection with the Credit Card; or
i. An event or circumstance transpires that, in Metrobank’s reasonable opinion, will adversely affect Card Member’s performance or payment of obligations under these Terms and Conditions.
In any event of default, the Card Member authorizes Metrobank to report and/or include his/her name in the negative listings of any government agency, credit bureau or institution or other banks, credit card companies or financial institutions.
28. CONSEQUENCES OF DEFAULT. The following shall be the consequences of default, whether singly, concurrently, or successively:
a. The entire unpaid obligation and all other fees, charges and amounts payable to Metrobank under these Terms and Conditions shall become due and payable without need of demand, protest, or further notice of any kind, all of which will be deemed expressly waived by Card Member. Any action made by Metrobank which may be construed as demand or notice shall not in any way serve as an amendment or modification of this provision;
b. All monies, securities, and things of value that are now or may hereafter be in the hands of Metrobank or the Metrobank Group or both, on deposit or otherwise to the credit of or belonging to Card Member, shall be deemed assigned to Metrobank effective upon the occurrence of default. Metrobank is also authorized to automatically debit his/her deposit account for such amount as may be sufficient to cover full payment of the outstanding balance, or to sell at public or private sale such securities or things of value owned by Card Member, and then to apply the proceeds of such sale to any outstanding obligation of Card Member;
c. Any funds of Card Member that may now or later be in the hands of Metrobank or the Metrobank Group will be applied and set off against any amounts due and payable on Card Member’s Card account.
29. ASSIGNMENT AND WAIVER. The Card Member agrees that Metrobank may assign, discount or otherwise transfer part or all of its rights and/or obligations under any card transaction, including the assignment of receivables, together with any hold-out agreement and other accessory contracts, to affiliates or other parties, with notice to the Card Member. In the event of such assignment, the Card Member hereby irrevocably agrees not to assert against the assignee set-off rights of any obligations, which may be owed by Metrobank to the Card Member.
30. TRANSFER OF INFORMATION AND DATA SHARING. The Card Member and/or Supplementary Card Member(s) hereby consents and authorizes Metrobank to process, transfer, share, disclose and communicate any personal data as defined under the R.A. 10173 (The “Data Privacy Act of 2012”) and its implementing Rules and Regulations, information relating to the Credit Card accounts, or any of the Card Member’s or Supplementary Credit Card Member's basic credit data and any and all information concerning himself, his/her properties or investments with Metrobank, to any of the offices, branches, subsidiaries, affiliates, agents and representatives of Metrobank and third parties selected by any of them, including other financial institutions, collection and verification agencies, entities tasked to provide consumer credit reporting or reference schemes, the appropriate government agencies, including, but not limited to the National Privacy Commission, Credit Information Corporation pursuant to R.A. 9510 (the “Credit Information Act of 2008”) and third parties with whom Metrobank may reasonably share such information, wherever situated, for the following purposes:
a. in order to commence and facilitate the efficient delivery, administration, operation, and/or implementation of Credit Card and other products and services of Metrobank;
b. for the protection of the Card Member or Supplementary Card Member(s) or Metrobank against fraudulent, unauthorized, or illegal transactions;
c. in order for Metrobank to enforce its rights or perform its obligations by reason of any law, contract, or orders from any court or quasi-judicial and administrative offices;
d. in the prosecution or defense of Metrobank or its directors/officers/employees with regard to disputes or claims pertaining to the products and services of Metrobank; and
e. in order for Metrobank, its affiliates and/or subsidiaries within the Metrobank Group to offer or provide other related products and services to the Card Member or Supplementary Card Member;
f. cross-referencing, status enquiry, customer satisfaction surveys, collection of past due payments, cross-selling or the offering of the various products and services of Metrobank and its subsidiaries, affiliates and partners (Metrobank Group), credit opinion and evaluation by and for an entity belonging to the Metrobank Group, or application for insurance/bond products with insurance company within Metrobank Group;
g. in order for Metrobank, its affiliates and/or subsidiaries within the Metrobank Group to perform the required customer due diligence and Money-Laundering and Terrorist Financing risk management; and
h. in order to comply with legal, regulatory or other contractual obligations of Metrobank, with the corresponding duty to keep such information confidential in accordance with its privacy policies.
In addition to the foregoing, Metrobank and any branch, subsidiary, affiliate, agent and representative or third party may transfer and disclose any such information as may be required by law or regulation, including among others R.A. 9510 of the Credit Information Act of 2008 and R.A. 9160, or the Anti-Money Laundering Act, as amended by R.A.9194 and R.A. 10365. Conformity to these Terms & Conditions: The (1) signing of the Application Form or delivery Acknowledgment Receipt; and/or (2) signing at the signature portion at the back of Credit Cards shall constitute the Card Member’s or Supplementary Card Member’s written consent for any transfer, data sharing and disclosure of information relating to him/her and/or his/her account/s, properties and investments for the purposes indicated above and under applicable laws, rules and regulations, and shall constitute a waiver of claims and exempt Metrobank, any of the offices, branches, subsidiaries, affiliates, agents and representatives, and/or the Metrobank Group from liability under any and all bank deposit secrecy laws, including, but not limited to, R.A. 1405 or The Law on Secrecy of Bank Deposits, R.A. 6426 or The Foreign Currency Deposit Act, R.A. 8791 or The General Banking Law, as well as R.A. 10173 or the Data Privacy Act of 2012, R.A. 9510 the Credit Information Act of 2008 and other confidentiality laws enforced or which may hereinafter be enforced.
The Card Member or Supplementary Card Member shall hold Metrobank harmless from suit and free from damages for any loss, damage or injury that the former may incur or sustain by reason of processing, transfer, or sharing of his/her personal data under R.A. 10173, or arising from any credit card feature, service or facility provided or rendered by a third party engaged by Metrobank to provide such feature or render such service or facility.
31. PROMOTIONAL OFFERS. On occasion, Metrobank may inform the Card Member about its promotional offers through mail, email, SMS, messaging applications, social media channels or by telephone. With the Card Member’s consent in the Application Form, or Acknowledgment Receipt, or assenting to an audio recording, or the act of using the Credit Card, Metrobank may also allow its branches, subsidiaries, affiliates, agents and representatives and third parties selected by any of them and certain companies to offer specially selected products and services to the Card Member through mail, email, SMS, messaging applications, social media channels or by telephone. Conformity to these Terms and Conditions shall constitute the Card Member’s consent for any processing, transfer, sharing and disclosure of information of the Card Member’s name, address, contact details and other relevant information to Metrobank’s affiliates, agents and representatives and third parties selected by any of them and certain companies for the purposes indicated above and under applicable laws and regulations.
32. COLLECTION
a. ENDORSEMENT TO COLLECTION AGENCIES. The Card Member and/or Supplementary Card Member(s) consents and authorizes Metrobank to process, share or transfer his/her personal data to Metrobank’s agency/agent for collections should the account be referred to an agency/agent for collections activity.
b. COLLECTION FEE. In case it is necessary to collect the total obligations through an attorney-at-law or collection agency, the Card Member, Supplementary Card Member(s) and/or co-obligor, jointly and severally, shall pay a portion of the amount due as attorney’s or collection fees, in addition to cost and other litigation expenses.
33. OWNERSHIP OF THE CREDIT CARD. The Credit Card is the exclusive property of Metrobank and is non-transferable. It shall be valid from the date of its issuance or renewal until the last day of its indicated expiry month. Subject to existing laws and regulations, Metrobank may, at its exclusive option and with notice, suspend, cancel, withdraw or terminate any Credit Card issuance and/or its privileges at any time. Moreover, all purchases/installments, cash advances, and charges shall become immediately due and demandable without need of further notice or demand. The Card Member and/or Supplementary Card Member(s) hereby hold Metrobank harmless from any liability arising from such acts.
Metrobank can change the Credit Card number and/or expiry date when issuing a renewal or replacement card to the Card Member or Supplementary Card Member(s). The Card Member and/or Supplementary Card Member(s) is/are solely responsible for communicating this change to any party with whom the Card Member may have payment arrangements. Metrobank will not be responsible for any consequence arising from declined transactions, whether under the old card number or otherwise.
In case of renewal or replacement of old Card/s, or upon cancellation or termination of membership, the Card Member or Supplementary Card Member(s) shall destroy the old Credit Card/s by perforating or punching holes on the chip/s and magnetic stripe/s to prevent any unauthorized usage. Upon receipt of a renewal or replacement Credit Card, the Card Member shall immediately use the same and the old Credit Card/s will automatically be deactivated once the renewal or replacement Credit Card is activated. For the avoidance of doubt, it hereby understood that the existing and unexpired Credit Card will remain activated until the renewal or replacement Credit Card is activated by the said Card Member and/or Supplementary Card Member(s). Metrobank shall not be liable for changes made on cards which have not been destroyed in the manner prescribed in this paragraph.
34. CARD MEMBER INSTRUCTIONS. TThe Card Member authorizes Metrobank to rely upon and act in accordance with any notice, instruction or other communication, which may, from time to time, be given by telephone, mobile phone, text messages, e-mail, messaging applications, social media channels, or other electronic means, which Metrobank believes, to have been made by the Card Member. The same instruction may be made on behalf of the Card Member through a Special Power of Attorney executed for this purpose. Metrobank, however, reserves the right to require the instructions to be contained or sent in a particular form or to have the instructions confirmed before it may decide thereon. Metrobank shall be entitled to treat the instructions as fully authorized by and binding upon the Card Member and to take such steps in connection with or on reliance upon the instructions as Metrobank may consider appropriate.
In consideration of Metrobank acting in accordance with the terms of such instruction, Card Member hereby irrevocably undertakes to indemnify Metrobank and to keep Metrobank indemnified against all losses, claims, actions, proceedings, demands, damages, costs and expenses of whatever nature, arising out of or in connection with the implementation of the instruction.
35. UPDATING OF INFORMATION. The Card Member and/or Supplementary Card Member(s) undertakes to notify Metrobank, through the Metrobank Customer Service Hotline at 88-700-700 (Metro Manila) or 1-800-1-888-5775 (Domestic Toll-Free using a PLDT line) or by writing Metrobank, of any additional means of communicating to him/her aside from what is disclosed in the Credit Card application, as well as any change in the Card Member’s address, home, office or billing address, e-mail and telephone number.
The Card Member and/or Supplementary Card Member(s) is responsible for notifying Metrobank of any change in other information, such as civil status, citizenship, employment details and income and agrees to provide Metrobank documents that may be required to enable Metrobank to comply with any law or regulation or any government requirement.
In case the billing is not accessible through mail or delivery, Metrobank has the option to use other addresses notified to Metrobank. Notwithstanding this provision, the Card Member agrees that any communication sent to the designated billing address shall be considered as received by the Card Member within ten (10) calendar days after mailing.
Metrobank shall not be responsible for the non-receipt of any notification, statement of account, promo-related message, One Time Password (OTP) as a result of the failure of the Card Member and/or Supplementary Card Member(s) to timely update their information.
36. DISHONOR OF CREDIT CARD/DEFECTIVE PURCHASES. The Card Member, Supplementary Card Member(s) and/or co-obligor, agree to hold Metrobank, its officers and employees free and harmless from any liability arising from the failure of any accredited establishment, Metrobank or third-party merchants, to honor the Credit Card or from the defect of or flaw in any merchandise or services purchased/obtained. The Card Member, Supplementary Card Member(s) and/or co-obligor’s liability to Metrobank is absolute, and existence of any dispute with any accredited establishment shall not, in any manner, affect their outstanding obligations.
37. LOST OR STOLEN CARD. In the event the Credit Card is lost or stolen, the loss or theft must immediately be reported through the Metrobank Customer Service Hotline at 88-700-700 (Metro Manila) or 1-800-1-888-5775 (Domestic Toll-Free a PLDT line). The Card Member, Supplementary Card Member(s) and/or co-obligor shall continue to be liable for all usages prior to Metrobank’s receipt of advice of the fact of the card’s loss or theft, including but not limited to, fraudulent or unauthorized transactions and/or forged signature by any person. The Card Member and/or Supplementary Card Member(s) shall hold Metrobank, its stockholders, directors, officers, employees and agents free and harmless from whatever liabilities or damages related to the usages on the card, unauthorized use of his/her personal data or Credit Card information that may be derived from the lost or stolen card. A card replacement fee, as Metrobank may advise and announce, shall be charged to the Card Member to cover the replacement of the Credit Cards and the costs in disseminating information about the loss or theft. Card Member’s and/or Supplementary Card Member’s liability for all purchases and/or cash advances made through the use of the lost or stolen card will cease only upon verbal notification to and actual recording thereof by Metrobank. The replacement card will have a new Credit Card number.
38. USE OF ONE-TIME-PASSWORD (OTP). The Card Member and/or Supplementary Card Member(s) acknowledges that Metrobank - as warranted by the transaction, may conduct a verification process; including but not limited to merchants, which may require the use of the One-Time-Password (OTP) as an additional security feature to authenticate online card transactions. The Card Member and/or Supplementary Card Member(s) may be required to input the OTP as required by the prescribed verification procedures before a transaction is officially completed. The Card Member and/or Supplementary Card Member(s) further acknowledges that the OTP is strictly private and confidential and should never be disclosed to anyone including card information, such as the expiry date, CVV or CVC (3 digits found at the signature panel of the Credit Card) among others.
The Card Member and/or Supplementary Card Member(s) shall ensure that his/her electronic mail address and/or mobile number on record are updated. In no case shall Metrobank be held liable or responsible for any loss or damage incurred by the Card Member and/or Supplementary Card Member(s) resulting from his/her disclosure of the OTP or any contact details and Card Member and/or Supplementary Card Member(s) and card information. The Card Member and/or Supplementary Card Member(s) agrees to hold Metrobank free and harmless from any liability, claim, cost and suit in connection with the administration and implementation of the OTP authentication process or such other Metrobank-prescribed verification procedures.
39. REPORTING OF UNAUTHORIZED TRANSACTION. The Card Member should immediately report to Metrobank any unauthorized transactions by calling the Metrobank Customer Service Hotline at 88-700-700 (Metro Manila) or 1-800-1-888-5775 (Domestic Toll-Free using a PLDT line) for proper assistance to block and replace the credit card. Reporting via informal channels (e.g. Bank Personnel email or contact number) that do not support real time assistance is highly discouraged as this may subject the Credit Card account to further unauthorized transactions.
The Bank may send an SMS message to request for verification for Card Member’s security and protection. The Card Member should immediately act upon the instruction noted in the SMS which may include sending of an SMS response subject to standard carrier charges.
40. CANCELLATION OR TERMINATION BY CARD MEMBER. Termination may, at any time and for whatever reason, be initiated by the Card Member and shall be processed only upon notification by the Card Member by telephone, or other means of communication of his/her intention to terminate his/her membership and the full settlement of his/her Card account including all enrolled bills. Termination shall take effect on or before the tenth (10th) day after satisfying above-mentioned conditions (Termination Effective Date), subject to the immediate payment or settlement of the Total Outstanding Balance. Metrobank reserves the right to conduct a confirmation call prior to the termination of the Card account. The Card Member is duty bound to cancel all his/her enrolled bills with the corresponding merchants.
41. DEATH, INCAPACITY OR ABSENCE BY CARD MEMBER; REFUND OF OVERPAYMENTS. IIn the event of the Card Member’s death, incapacity, or judicial declaration of absence or presumptive death, the Card Member’s spouse, Supplementary member (s), co-obligor, or heirs, or the company in case of corporate accounts stated in Clause 5 above, undertakes to immediately notify Metrobank of the fact thereof through the Metrobank Customer Service Hotline at 88-700-700 (Metro Manila) or 1-800-1-888-5775 (Domestic Toll-Free using a PLDT line)or by writing Metrobank, and agrees to provide all necessary documents which may be requested by Metrobank.
Upon reporting the Card Member’s death, incapacity, absence or presumptive death and providing the necessary documents:
a. the Card Member’s account shall immediately be closed;
b. all outstanding balances and charges, if any, shall become due and demandable, and the provisions under Clauses 27 (Default) and 28 (Consequences of Default) shall apply; and
c. enrolled Card services using the Card Member’s Card account/s shall also be cancelled.
The Card Member, supplementary member(s) and/or co-obligor shall continue to be liable for all usages, including but not limited to, fraudulent transactions and/or forged signature by any person and other charges related thereto, prior to Metrobank’s receipt of advice of the fact of the Card Member’s death, incapacity, absence or presumptive death.
Should the Card Member regain legal capacity or reappear, he/she may apply with Metrobank to revert the Card into active status.
The Card Member shall hold Metrobank, its stockholders, directors, officers, employees and agents free and harmless from whatever liabilities or damages related to the usages on the card, unauthorized use of his/her personal data or Credit Card information in connection with the Card Member’s death, incapacity, absence or presumptive death.
42. TELEPHONE COMMUNICATIONS. The Card Member and/or Supplementary Card Member(s) agrees, consents and authorizes Metrobank or any of its telesales, telemarketing or customers service agents, and outsourced agencies to record and store all the Card Member and/or Supplementary Card Member(s)’ telephone, mobile phone or any other similar communications, generated or received during the Card Member and/or Supplementary Card Member(s)’ call or accepted calls from Metrobank. All taped or recorded communications shall be the exclusive property of Metrobank. Subject to existing laws or regulations, the Card Member and/or Supplementary Card Member(s) further agrees that Metrobank may, without disclosing the reason therefor, deny any request of Card Member for retrieval of taped or recorded communications. The Card Member and/or Supplementary Card Member(s), likewise, agrees that such taped or recorded communications may be used by Metrobank or any third party, for any purpose, particularly as evidence in any proceeding, judicial or administrative.
43. SMS COMMUNICATIONS. The Card Member and/or Supplementary Card Member(s) hereby agrees that Metrobank may send or communicate through text messages or through the Card Member’s and/or Supplementary Card Member(s)’ SMS-enabled cellular phone for specific and timely prompts, reminders and notices from time to time concerning account information, internet security, and other matters relating to the Credit Card. The Card Member and/or Supplementary Card Member(s) hereby acknowledges and accepts that each SMS may be sent to the Card Member and/or Supplementary Card Member(s) without being encrypted and may include the Card Member’s name and information pertaining to the Card Member and/or Supplementary Card Member(s)’ Credit Card account. It is the Card Member and/or Supplementary Card Member(s)’ responsibility to ensure the security of his/her mobile phone and the Card Member and/or Supplementary Card Member(s) hereby holds Metrobank free and harmless against any and all liability, administrative, civil, or criminal, including but not limited to R.A. 10173 (The "Data Privacy Act of 2012") or those relating to any secrecy laws or regulations, should any SMS be viewed or accessed by any persons other than the Card Member. The Card Member and/or Supplementary Card Member(s) agrees that Metrobank does not guarantee the timely delivery or accuracy of any SMS, which are purely for convenience, information and notification purposes only. The Card Member and/or Supplementary Card Member(s) shall be fully responsible to monitor the due performance and compliance of his/her obligations.
44. ELECTRONIC NOTIFICATION. Notifications sent by Metrobank to the Card Member and/or Supplementary Card Member(s) through mobile phones, e-mail or other electronic means using the number and address of record shall be deemed to have been sent to the Card Member and/or Supplementary Card Member(s) himself. As such, the Card Member and/or Supplementary Card Member(s) hereby declares, Metrobank free and harmless from any liability if the information contained in the electronic notification is, by any means, accessed by any person other than the Card Member and/or Supplementary Card Member(s).
45. REVISION OF TERMS AND CONDITIONS. Metrobank may modify this Terms and Conditions at any time, and any such change or modification is deemed to be binding on the Card Member upon sixty (60) days’ prior notice or publication in a manner Metrobank considers appropriate, unless otherwise directed by the BSP, existing laws, rules and regulations. This is unless Card Member objects to those change/s by manifesting the intention to terminate his/her Card account in writing within five (5) days from notice of the amendment. Failure of Card Member to notify Metrobank about this intention to terminate his/her Card account as provided and/or Card Member’s continued use of the Card, or both, shall be construed as acceptance by Card Member of the amendments.
Any amendment, revision, or changes in this Terms and Conditions, as provided above, shall likewise be binding on the co-obligor (if any) and Supplementary Card Member/s, who hereby irrevocably and unconditionally waives his/her right to consent thereon or notification thereof. The Card Member hereby undertakes to notify such co-obligor of the amendments to this Terms and Conditions, if any.
46. FILING A COMPLAINT. When filing a complaint, the Card Member may:
Call Metrobank's Customer Service Hotline at 88-700-700 Domestic Toll-Free Hotline 1-800-1888-5775 (using a PLDT line), or International Toll-Free Hotline at (+your country and area codes) 800 8700 0707. For concerns while overseas, refer to the list of Customer Service International Toll-Free hotlines found at https://www.metrobank.com.ph/help#FAQ-Credit Cards. The Card Member shall provide his/her card number, updated mobile number and email address, and relevant details of his/her complaint; or
Send Metrobank an email at [email protected] for products and service concerns. For Collections related concerns, the Card Member should send an email at [email protected] and give his/her full name, contact information, and relevant details of the complaint. For the security and protection of his/her account, only the last ten digits of the Card Member’s Credit Card number shall be required.
In disputing a Credit Card charge, the Card Member is required to accomplish a dispute form, a copy of which is available at Metrobank's website at https://www.metrobank.com.ph/downloads. The dispute form may be submitted through email at [email protected].
Metrobank shall conduct an investigation in accordance with its established procedures and shall notify the Card Member of its findings. Metrobank will endeavor to respond to the complaint raised within 7 to 10 banking days. For complaints or concerns requiring more time to resolve, the Card Member will be informed of the progress update of the concern.
Metrobank is supervised and regulated by the Bangko Sentral ng Pilipinas (https://www.bsp.gov.ph).
If you are not satisfied with the resolution of your complaint, you may appeal for a reinvestigation and/or utilize any available remedies provided under the BSP Consumer Assistance Mechanism or other recourse under the law or regulations.
47. GOVERNING LAW AND VENUE OF ACTIONS. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Venue of all suits directly or indirectly arising from this instrument or from the relationship between Metrobank and the Card Member or supplementary member(s), and/or co-obligor, shall be limited to the proper courts of Makati City to the exclusion of all other venues.
48. WAIVER OF BREACH OF CONTRACT. No waiver of a breach or violation of any term or condition hereof shall constitute a waiver of any subsequent breach or violation of the same or any other term or condition. Failure by Metrobank to take advantage of or to exercise any right granted hereunder shall not constitute a waiver of said right, nor shall it be construed to excuse or absolve the Card Member, supplementary member(s) and/or co-obligor from complying with or fulfilling the same.
49. SEPARABILITY CLAUSE. Should any of the terms and conditions or any part or clause of this instrument be declared void or unenforceable by competent authority, the same shall not invalidate the other terms and conditions, parts or clauses of this Terms and Conditions.
50. REGULATORY LIMITATIONS. The Card Member and/or Supplementary Card Member(s) agrees not to use the Credit Card for the purchase of items/goods the importation into the Philippines of which is subject to the provisions of BSP Circular No. 1389, as amended, and all other circulars, laws, rules and regulations pertaining to importation. Likewise, the Card Member and/or Supplementary Card Member(s) agrees and warrants that the proceeds of any cash advance availments abroad shall not be used for foreign investments or the payment of foreign loans or in violation of any existing foreign exchange rules and regulations.
51. DISCLOSURE. By signing on the Credit Card Application Form, delivery Acknowledgment Receipt, or by signing at the signature portion at the back of the Credit Cards or through audio recording, the Card Member and/or Supplementary Card Member(s) consents and authorizes Metrobank, its authorized representative (s) or agents to:
a. transfer, process, disclose, share, receive and exchange personal data as defined under the Implementing Rules and Regulations of R.A. 10173 (The “Data Privacy Act of 2012”), credit data and any and all information concerning the Card Member, supplementary member(s) and/or co-obligor, if any, with other financial institutions, entities tasked to provide consumer credit reporting or reference schemes, including but not limited to The National Privacy Commission, Credit Information Corporation pursuant to R.A. 9510, etc. and third parties with whom Metrobank may reasonably share such information;
b. acquire any information from Metrobank and PSBank to facilitate the approval of his/her Credit Card application as well as all Credit Card transactions, e.g. cash advance, increase in credit limit, etc. initiated by the Card Member and/or Supplementary Card Member(s); and
c. to verify and investigate the aforesaid facts from whatever source(s) it deems appropriate in the event of default arising from non-payment of his/her Credit Card obligations with Metrobank, the Card Member and/or Supplementary Card Member(s)authorizes Metrobank. The Card Member and/or Supplementary Card Member(s)shall hold Metrobank free and harmless from any liability that may arise from such disclosure.
52. DISCRETIONS. Without giving any reason, and without prejudice to the other provisions hereof, Metrobank has the full discretion to:
a. refuse to approve any proposed Card transaction even if there is sufficient credit available;
b. suspend, terminate or cancel the Card Member’s and his/her supplementary member(s) right to use the Card;
c. increase or decrease the credit limit;
d. refuse to re-issue, renew or replace the Card; and/or
e. introduce, amend, vary, restrict, terminate or withdraw the benefits, services, facilities and privileges with respect to or in connection with the Card account, whether specifically relating to the Card Member or generally to all or specific Card Members.
Metrobank shall not be responsible if it does not approve a purchase, cash advance, or any other Card Transaction, on the card account of the Card Member and/or Supplementary Card Member(s) even if there is sufficient credit limit available. Neither shall Metrobank be responsible if the merchant does not accept or honor the Credit Card, even if there is sufficient credit limit available.
Metrobank may limit the number and/or amount of purchases, cash advance or other Card Transactions which may be approved in one day. If Metrobank detects any unusual or suspicious activity on the Card account, Metrobank may require the Card Member and/or Supplementary Card Member(s) to contact Metrobank or temporarily suspend the Card Member’s credit privileges until Metrobank has verified the activity. Metrobank may likewise approve purchases, cash advance or other Credit Card Transactions, which, in the aggregate, cause the balance to exceed the credit limit without waiving any of Metrobank’s rights hereunder.
53. FAIR TREATMENT. In the exercise of its discretion under these Terms and Conditions, no cancellation, suspension, termination, denial or rejection by Metrobank of any application or any transaction by Card Members and/or Supplementary Card Member(s) or customers shall be on the basis of race, age, financial capacity, ethnicity, origin, gender, disability, health condition, sexual orientation, religious affiliation, or political affiliation.
54. ACCEPTANCE. All the terms and conditions herein stated, including the Terms and Conditions in separate documents for Cash2Go, Balance Conversion and Balance Transfer, Schedule of Metrobank Credit Card Fees and Charges, and any amendments thereto, have been read and fully understood by the Card Member as evidenced by the Card Member’s signature either on the application form, acknowledgement receipt, or the physical Credit Card, and/or other forms of documents evidencing charges to the Credit Card, or when the Card Member retains or uses the Credit Card. Card Member shall be responsible in informing the co-obligor (if any) of these Terms and Conditions.
55. NO PDIC COVERAGE. The Credit Card account is not a deposit account and is not covered nor insured by the Philippine Deposit Insurance Corporation.
